Conclusion and termination of a Sales Agreement

These Terms and individual sales conditions indicated with product information represent an offer from Secret d.o.o. to conclude an Agreement, and the User as a buyer accepts them by registering, placing an order, or in another manner defined by these Terms, whereby the Agreement between the User and Secret d.o.o. is considered concluded, according to the sales conditions stated in these Terms.

The subject and commercial purpose of the Agreement is the purchase of a selected product or service through www.sex-shop.hr (hereinafter referred to as Fortuna) by paying the appropriate fee – the price of that product or service. The Agreement is concluded by means of distance communication (distance contract) via: printed promotional messages with an order form, telephone with and without human intervention, and the Internet.

The agreement enters into force and becomes binding from the moment the user accepts the offer of Secret d.o.o. in one of the following ways:

by selecting payment and completing the order as a registered user of the Fortune webshop,
by choosing payment and completing the order as a guest user of the Fortune webshop,
by selecting payment and completing the order via the 099/800-6340 phone line
by selecting payment and completing the order via the email address info@sex-shop.hr

During the registration or user account creation process, the user is obliged to select a username or name under which they will access the services and choose a security password, as well as provide a valid email address. All data required for registration or user account creation must be truthful, and the use or utilization of another person's data is expressly prohibited.

b) Registration or user accounts are created for one person only, and it is not permitted to disclose registration or user account information to third parties. The user is obliged to safeguard their security password and user account information. The use of another person's registration or user account is not permitted.

c) For violation of the provisions of the Terms of this chapter, Secret d.o.o. reserves the right, at its sole discretion, to terminate the user's registration or user account, without any obligation to compensate the user for any cost or damage.

d) Registration (which includes payment for the service) shall be deemed to constitute a Contract between Secret d.o.o. and the user as the customer.

e) The Agreement shall enter into force upon the registration of the User, or from the day the User accepts the offer to conclude such an Agreement.

f) Upon conclusion of the Agreement, the user shall be provided with: confirmation of the concluded Agreement, or pre-contractual information pursuant to Article 57, Paragraph 1 of the Consumer Protection Act (Official Gazette, no. 41/2014), these Terms and Conditions, and a notice of the user's right to unilateral termination of the Agreement with the form for unilateral termination of the Agreement pursuant to Article 61, Paragraphs 1 and 2 of the Consumer Protection Act.

g) The User may unilaterally terminate the Agreement within 14 (fourteen) days without stating a reason. The User is not entitled to unilaterally terminate the Agreement:
– if the service has been fully performed, and the performance commenced with his explicit prior consent and with his confirmation that he is aware that he will lose his right to unilateral termination of the Contract if the service is fully performed,
– if the subject of the Contract is goods which are not suitable for return for health or hygiene reasons, if they have been used after delivery and are not in their original packaging or if it is torn, crumpled or damaged
– if the subject of the Contract is goods which, by their nature, after delivery are inseparably mixed with other things,

In order for the user to exercise their right to unilaterally terminate the Agreement, they must notify Secret d.o.o. of their decision to unilaterally terminate the Agreement before the deadline expires by means of an unambiguous statement sent by mail (to www.sex-shop.hr, Secret d.o.o., Vlašićka 26, Osijek) or by electronic mail to secret@secret.hr, in which you will state your first and last name, address, phone number or email address, and you may also use the provided written form for unilateral termination of the Agreement.

Also, the User can electronically fill out and submit the Unilateral Contract Termination Form, in which case Secret d.o.o. will promptly provide confirmation of receipt of the notice of unilateral contract termination via email.

The period for unilateral termination of the Agreement is 14 (fourteen) days from the date when the customer or a third party designated by the customer, who is not a carrier, took possession of the goods that are the subject of the Agreement, or in the case of services, from the conclusion of the Agreement.

If the user unilaterally terminates the Agreement, the funds received from them, including delivery costs, will be refunded without undue delay, and at the latest within 14 (fourteen) days from the date Secret d.o.o. receives the user's decision to unilaterally terminate the Agreement, or when Secret d.o.o. receives the items that are the subject of the Agreement and unequivocally determines that they meet the conditions for a refund as previously described. The refund will be made in the same manner as the user made the payment. In case the user agrees to a different method of refunding the amount paid, they will not incur any costs in relation to the refund.

The user is obliged to return the goods or send them to the address of Secret d.o.o., Vlašićka 26, Osijek, without undue delay, and in any case no later than 14 (fourteen) days from the date on which they sent their decision to terminate the Contract unilaterally to Secret d.o.o. The user bears the direct costs of returning the goods. The user is kindly asked to call 099/800-6340 or contact secret@secret.hr before terminating the Contract, so that the procedure for returning the goods can be explained.

The user is responsible for any diminished value of the goods resulting from handling the goods, beyond what was necessary to establish the nature, characteristics, and functionality of the goods. In case of damage to the original packaging, the refund amount will be reduced by a percentage corresponding to the value of the goods. You will be notified in this case.

If, at the user's request, the provision of the service commenced during the contract termination period, the user is obliged to pay 24 hours the amount proportionate to what was delivered up to the moment the user notified Secret d.o.o. of the unilateral termination of the Contract.

Main product features, usage instructions, prices, special offers and benefits, and payment and delivery methods refer to those that are valid at the time of order completion. The provided information will be indicated with each product.

The product price, which includes VAT and shipping costs, is visible in the shopping cart before completing the order. Shipping costs may also be visible in other sections of the website. All information regarding purchase confirmation based on an electronic order will be sent to the customer's email address provided during registration/ordering or in the shopping cart when entering data during order completion. All prices are expressed in euros (€). VAT is included in all prices.

If the customer does not receive an order confirmation notice, there is a possibility that they entered their email address incorrectly. The cost of shipping depends on many parameters and therefore is not included in the item prices.

Delivery is made via the GLS delivery service and taxi delivery for the area of the city of Osijek and its suburbs. The cost of delivery is described in detail on the online store page in the DELIVERY AND PACKAGING section.

In case of a change in the delivery deadline or any other important circumstance affecting order fulfillment, the customer will be immediately notified.

Ordered products are packaged so they will not be damaged by normal handling during transport/delivery. The customer is obliged to inspect the packaging of the shipment upon receipt.

If the shipment packaging has visible damage/defects, we recommend that the buyer refuse to accept it, as there is a possibility that the product inside such packaging is damaged. By refusing to accept it, the delivery service will return the shipment to Fortuna, noting that the shipment has a defect.

In case of a justified complaint, contract termination with a refund of the paid amount or product replacement is allowed.

If there is damage and/or malfunction of the delivered goods, the buyer must send a photograph of the said claim for it to be accepted based on physical evidence. Secret d.o.o. will collect the advertised damaged, defective, or incorrectly delivered goods at its own expense, provided that the claim is found to be justified and that the buyer has not contributed to the defect, damage, or any shortfall of the goods. In the case of a justified claim, the cost of replacing the product with a new one will be entirely borne by Secret d.o.o.

In case of a dispute regarding the validity of a complaint and/or the manner in which the product was returned (the product must be unused, in its original quantity and packaging, with the original receipt and warranty, if applicable, presented), the product will be submitted for expert examination to an expert or a specialized legal entity.

In the event that the expert examination determines the justification of the complaint, all costs of the expert examination and product replacement shall be borne by Secret d.o.o., and in the case of an unjustified complaint, the costs shall be borne by the customer.

Warranty for the proper functioning of sold products and service

Products for which we provide a warranty in accordance with the law and the warranty specified by the manufacturer have a warranty card.

The right to use the warranty is exercised by presenting the invoice and the warranty card. The buyer is obliged to keep the warranty card and the invoice. The invoice date is the date the warranty becomes active. The product description includes information on the warranty period for a specific product.

In the event of issuing a warranty certificate by which the manufacturer guarantees the product's functionality for a specified period, the buyer may, if the product is not functional, request that the product be repaired within a reasonable time, or that it be replaced with another identical, functional product instead of repair. If a product defect occurs during the warranty period, the product should be delivered to the authorized service center listed in the warranty certificate.

The right to use the warranty is exercised exclusively upon presentation of the receipt. The buyer is obliged to keep the warranty card and the receipt. Product defects resulting from improper use and/or failure to follow instructions are not covered by the warranty. Servicing and sale of spare parts for the purchased product are provided through authorized service centers listed in the warranty card.

Payment of the product price and shipping costs can be made in one of the following ways:

Payment by direct bank transaction (general payment slip). Products for which an order has been placed can be paid for by bank transfer using a general payment slip at all bank branches, FINA offices, Croatian Post offices, or via internet or mobile banking. After order confirmation, Secret d.o.o. will send the payment details for the general payment slip via email. All details must be accurately entered on the general payment slip and the payment must be made within the specified timeframe.

Card payment via the Monri WSPay system. After selecting card payment when completing your order, you will be redirected to the Monri WSPay payment system. After the payment is completed, Secret d.o.o. will receive a payment authorization notification via email, and the order can be shipped.

Advance payment (for legal entities only). Legal entities have the option of paying by advance invoice. After order confirmation, Secret d.o.o. will send the advance invoice to the customer's email address. The delivery process will be initiated upon receipt of payment according to the advance invoice.

Payment in cash - upon delivery. When collecting the shipment, the entire amount indicated on the invoice, including the delivery cost, is paid to the delivery person.

Secret d.o.o. commits to respecting user anonymity and privacy and will use and process data solely for the purpose and intent defined in these Terms.

Secret d.o.o. may collect users' personal data, such as name, address, unique personal identification number (OIB), phone number, or email address, only if the user voluntarily provides them to Secret d.o.o.

Secret d.o.o. will use the provided data exclusively for the purpose of fulfilling contractual obligations and for a better insight and understanding of individual user needs, habits, and requirements, as well as for the further development and improved provision of all Fortune services.

Secret d.o.o. collects, processes, and publishes data about users related to how the webshop is used, without revealing the user's identity and/or personal data that could identify the user.

Secret d.o.o. collects and records user IP address (Internet Protocol Address) data or computer location data for system administration purposes, troubleshooting, confirmation of content download, or improvement of technical aspects of the internet service.

Secret d.o.o. will automatically record data on user habits in the web shop, including log files of visits to specific pages and/or content. Secret d.o.o. will use such data exclusively for the purpose of improving its service and for the adjustment and individualization of promotional activities according to the needs of each user.
